1. Agreement to Terms

By downloading, installing, or using ShotSnap ("the Application" or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.

ShotSnap is a screenshot application designed for macOS that provides tools for capturing, analyzing, and organizing screenshots with AI-powered features.

2. Eligibility

You must be at least 13 years old to use ShotSnap. By using the Application, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the Application on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. License and Use

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use ShotSnap on macOS devices that you own or control, solely for your personal or internal business purposes.

3.2 Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the Application
  • Reverse engineer, decompile, or disassemble the Application
  • Remove, alter, or obscure any proprietary notices in the Application
  • Use the Application for any illegal or unauthorized purpose
  • Use the Application to violate any laws or regulations
  • Interfere with or disrupt the Application or servers connected to it
  • Use the Application to capture, store, or share content that violates third-party rights or is illegal

4. macOS Requirements and Permissions

ShotSnap requires macOS and certain system permissions to function:

  • System Requirements: ShotSnap requires macOS 12.0 (Monterey) or later. You are responsible for ensuring your device meets these requirements.
  • Screen Recording Permission: ShotSnap requires screen recording permission to capture screenshots. You grant this permission through macOS System Settings.
  • File System Access: ShotSnap requires file system access to save and organize screenshots. You control which folders the Application can access.

Failure to grant necessary permissions may result in limited or non-functional features. We are not responsible for issues arising from insufficient permissions or incompatible system configurations.

5. User Content and Screenshots

Ownership: You retain all ownership rights to screenshots and content you create using ShotSnap. We do not claim ownership of your screenshots or content.

Your Responsibilities: You are solely responsible for:

  • The content of screenshots you capture, including ensuring you have the right to capture and store such content
  • Complying with all applicable laws and regulations when using screenshots
  • Respecting intellectual property rights, privacy rights, and other rights of third parties
  • Not capturing or storing content that is illegal, harmful, or violates third-party rights

Prohibited Content: You agree not to use ShotSnap to capture, store, or share content that:

  • Is illegal, harmful, or violates any laws
  • Infringes on intellectual property rights
  • Violates privacy rights or contains personal information without consent
  • Is defamatory, harassing, or abusive
  • Contains malware, viruses, or other harmful code

6. AI Features and Processing

ShotSnap includes AI-powered features such as image analysis, text extraction, and smart categorization. When you use these features:

  • Your screenshots may be processed by third-party AI service providers
  • Processing is performed securely and in accordance with our Privacy Policy
  • AI-generated analysis and insights are provided "as-is" and may not always be accurate
  • We are not responsible for the accuracy, completeness, or reliability of AI-generated content

You acknowledge that AI features are experimental and may produce incorrect or unexpected results. Use AI-generated content at your own discretion.

7. Payment and Subscriptions

If ShotSnap offers paid features or subscriptions:

  • Payments are processed through the Mac App Store or other authorized payment processors
  • Subscription fees are charged in advance and are non-refundable unless required by law
  • You are responsible for any applicable taxes
  • We reserve the right to change pricing with notice to existing subscribers
  • Subscriptions automatically renew unless cancelled before the renewal date

Refund policies are governed by the Mac App Store's terms and conditions, where applicable.

8. Intellectual Property

The Application, including its design, features, functionality, and content (excluding user-generated screenshots), is owned by ShotSnap and protected by copyright, trademark, and other intellectual property laws.

ShotSnap, the ShotSnap logo, and related marks are trademarks of ShotSnap. You may not use our trademarks without our prior written permission.

9. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Application will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of AI-generated content
  • Warranties that defects will be corrected

We do not guarantee that the Application will meet your requirements or that the operation of the Application will be uninterrupted or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOTSNAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Application
  • Any unauthorized access to or use of your screenshots or data
  • Any errors or omissions in the Application
  • Any loss or corruption of screenshots or data
  • Any third-party conduct or content

Our total liability shall not exceed the amount you paid for the Application in the 12 months preceding the claim, or $50, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless ShotSnap and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the Application, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may terminate or suspend your access to the Application immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

  • Your right to use the Application will immediately cease
  • You must delete the Application from your devices
  • All provisions of these Terms that by their nature should survive termination will survive

You may stop using the Application at any time by uninstalling it from your device.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Application after such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ShotSnap operates, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the appropriate courts of that jurisdiction.
